Please note that regardless of whether you are purchasing or registering on the Web Interface, you must follow the following rules, which define and specify the terms of use of all functional components of the Web Interface (hereinafter also referred to as Terms of Use).

  1. Web Interface Registration

You can register on the Web Interface using the registration form available on the Web Interface. The registration form must be filled in with the required details, in particular first name, surname and contact e-mail. A user account is created by registration.

A user name and password are required to access the user account. Keep access data to the user account secret. Our company is not responsible for any misuse of the user account by a third party.

The information provided at the time of registration must be true and complete. We may cancel an account that has been used to create false or incomplete information without compensation.

In case of changes in your data, we recommend that you make an immediate adjustment to your user account.

Through a user account, you can primarily order goods, track orders, and manage the user account. Any additional features of the user account are always listed on the Web Interface. Please note that we have the right to cancel your user account without compensation if your account violates good manners, applicable laws or these Terms of Use.

 

  1. Protection of Personal Data

When filling in an order or registering on the Web Interface, you provide us with some of your personal data. Furthermore, when using the Web Interface, we have access to other collected, stored and processed data. By entering personal data and using the Web Interface, you consent to the processing and collection of your personal data to the extent set out below and for the purposes set out below, until the period of disagreement with such processing.

Your privacy is very important for us.  Therefore, when dealing with personal data, we proceed in accordance with the legal order of the Czech Republic, in particular Act No.101/2000 Coll., on the Protection of Personal Data (hereinafter also referred to as ZOOÚ), as amended.

2.1. What are personal and other information?

Personal data is the data that you voluntarily provide to us as part of filling in an order or registration. Personal data means any information that identifies or can identify a particular person. Personal data are, in particular, but not exclusively, the first and last name, photographs, date of birth, e-mail address and address of residence or telephone number.

Other data we collect automatically in connection with the use of the Web Interface are IP address, browser type, device and operating system, time and number of hits on the Web Interface, information obtained using cookies and other similar information. Please note that we may obtain this additional information without registration and regardless of whether you are shopping on the web interface or not.

2.2. How do we use personal and other data?

Through personal and other data, we mainly allow you to access your account and make it as easy as possible to use the Web Interface.

We also use the data for communication regarding the management of your account and for user support. Data may be used to improve our services, including using web interface user behavior analysis.

The data may be used for commercial and marketing purposes, i.e. to maintain a database of users of the Web Interface and to offer goods and services for an indefinite period of time. By sending an order or registering, you agree to the sending commercial communications by all electronic means.

You may withdraw your consent to receive commercial communications and e-mails for direct marketing purposes at any time by e-mail to our contact email address.

2.3. How do we manage and process your personal data?

Our company is a personal data controller within the meaning of ZOOÚ, and is kept in a register with the Office for Personal Data Protection under the registration number 00055191.

By processing your personal and other data, we may entrust a third party as a processor.

Personal and other data collected is fully secured against misuse.

Personal data will be processed for an indefinite period of time. Personal data will be processed electronically in an automated manner or in printed form in a non-automated manner.

2.4. To whom do we transfer your personal data?

We do not transfer your personal information to any other person. The exception is external carriers and persons involved in the supply of goods or the provision of services. To such persons, your personal data is transferred to the minimum extent necessary for the delivery of the goods or the provision of services.

2.5. What are your rights in respect of your personal data?

You have the right to access your personal data and the right to information about their processing (information on the purpose of the processing, information on the sources of such data and information about the recipient). This information will be provided to you without undue delay upon request. You also have the right to rectify personal data and other legal rights to such data.

Upon your written request, we will delete your personal data from the database.

If you believe that our company or processor of personal data is processing your personal data that is contrary to the law, you may:

* ask us or the processor for an explanation;

* ask us or the processor to rectify the situation. In particular, this may involve the blocking, correcting, supplementing or disposal of personal data.

When protecting your personal data, we will do our best to accommodate you. However, if you are not satisfied with the processing, you have the right to contact the competent authorities, in particular the Office for Personal Data Protection. This provision does not affect your right to contact the Office for Personal Data Protection directly with your complaint.

We may require reasonable payment for the provision of information on the processing of personal data, not exceeding the costs necessary to provide the information.

Supervision over the protection of personal data is performed by the Office for Personal Data Protection (http://www.uoou.cz/en).

Our company and potential personal data processors are based in the Czech Republic.

 

  1. Google Analytics and Cookies

The Web Interface uses Google Analytics, provided by Google, Inc. (hereinafter also referred to as Google).

3.1. What is Google Analytics?

Google Analytics uses “cookies”, which are text files stored on each visitor’s computer of the Web Interface and which help to analyze how the Web Interface is used.

The information generated by the cookie about the use of the website (including the IP address) will be transferred and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating the use of the Web Interface and reporting on the activity of its users, intended for us and for internet use at all. Google may also provide this information to third parties if required by law or if such third parties process such information for Google. Google will not associate the subject’s IP address with any other data at its disposal.

By using this Web Interface, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

3.2. Can you prevent cookies from being stored on your computer?

You can refuse the use of cookies by selecting the appropriate settings in your internet browser.

Please note that if you refuse the use of cookies, it is possible that you may not be able to take full advantage of all the functions of the Web Interface.

The content of websites located on the Web Interface (texts, photos, images, logos and others) including the Web Interface software and these Terms of Use, is protected by our copyright and may be protected by other rights of others. You may not modify, copy, reproduce, distribute or use the content for any purpose without our company’s consent or consent of the copyright holder. In particular, the free or paid access to photographs and texts placed on the Web Interface is prohibited.

The names and designations of products, goods, services, companies and companies may be registered trademarks of their respective owners.

4.1. How do we proceed with copyright infringement?

In non-compliance with the above-described prohibition, we will proceed in accordance with Act No. 121/2000 Coll., Copyright Act, as amended.

In particular, our company, as the copyright holder, has the right to demand that infringements of our copyrights be waived and to request the removal of unauthorized copies of protected content.

Furthermore, we have the right to demand reasonable satisfaction for the damage caused.

 

  1. Other Web Interface-Related Relationships

5.1. Please note that clicking on some links on the web interface may cause you to leave the Web Interface and be redirected to third party websites.

5.2. Our company is not responsible for errors caused by third party interventions in the web interface or as a result of its use contrary to its purpose. When using the web interface, you may not use mechanisms, software, scripts or other procedures that could adversely affect its operation, i.e. in particular disrupt the system or unduly burden the system, and you may not perform any activity that could allow you or third parties to tamper with or misuse the software or other components that make up the Web Interface and to use the Web Interface or parts or software thereof in a manner that is inconsistent with its purpose or purpose.

5.3. We cannot guarantee uninterrupted access to the Web Interface, nor the safety and security of the Web Interface. We are not liable for damage caused by accessing and using the Web Interface, including any damage caused by downloading data published on the Web Interface, damage caused by interruption, Web Interface failure, computer viruses, damages due to data loss, loss of profit or unauthorized access to transmissions and data.

5.4. If you engage in any illegal or unethical act while using the Web Interface, we may restrict, suspend or terminate your access to the Web Interface without any compensation. In this case, you are also obliged to compensate our company for the damage that was demonstrably caused by your actions pursuant to this paragraph, in full.

What do we follow when handling personal data?

When handling personal data, we proceed in accordance with the legal order of the Czech Republic and directly applicable regulations of the European Union, especially with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and free movement of such data and repealing Directive 95/46/EC (hereinafter also referred to as Regulation) and Act No. 480/2004 Coll., on certain Information Society Services and on Amendments to some Acts, as amended.

What is personal data?

Personal data means any information that identifies or can identify a particular natural person. Personal data are in particular (but not exclusively):

identification data, such as name and surname, identification number, tax identification number, date of birth, gender, and login name to the user account;

contact details, such as home address (or delivery address), telephone number, email address;

other data, such as information obtained through cookies, IP address (network identifier), including the type of browser, device and operating system, time and number of accesses to the Web Interface, and other similar information.

 

COLLECTION AND USE OF PERSONAL DATA

How do we obtain your personal data?

You provide us with your personal data especially when filling out the order (possibly as part of the contact form), or when creating a user account. If there is any change to your personal information, please let us know.

When visiting and using the Web Interface, certain personal data may also be obtained and stored via cookies. You can read more about cookies in Article 5 of this Policy.

On what basis and for what purposes do we process your personal data?

Personal data entered during inquiry (especially through the contact form) and ordering goods or services may be processed without your express consent on the basis of and for the purpose of concluding and fulfilling the Contract, i.e. for the purpose of delivery of goods or provision of services. Furthermore, we may process this data on the basis of and for the purpose of fulfilling our statutory obligations (especially registration obligations, archiving of tax documents, etc.) and on the basis of our legitimate interest for the purposes of protecting our legal claims.

We may process personal data entered when creating a user account without your express consent on the basis of the performance of the Contract and exclusively for the purpose of enabling access, administration and maintenance of the user account.

We may use your e-mail address without your express consent, based on our legitimate interest, to send commercial communications regarding our goods or services similar to those you have ordered from us. You can refuse sending business communications at any time.

If you give us your consent by confirming it on the Web Interface, we may process your personal data entered on the Web Interface, especially when filling out an order or creating a user account, for the purpose of sending commercial messages and direct marketing, or for other purposes with which you have expressly agreed. If you are under the age of 16, your will need your legal representative’s consent. In case of doubt, we may request confirmation of your age.

We may use your e-mail address and information about the goods or services you have purchased on the basis of our legitimate interest in order to review and improve our services and our goods and determine your satisfaction, through the “Verified by Customers” service of Heureka Shopping s.r.o. Your e-mail address will be forwarded to Heureka Shopping s.r.o. in order to send an evaluation questionnaire within the “Verified by Customers” service. If you fill in this evaluation questionnaire, Heureka Shopping s.r.o. will then evaluate your feedback for us. This questionnaire will be sent to your e-mail address after the purchase at intervals specified by Heureka Shopping s.r.o. and you can evaluate the quality of our services and products. You can refuse sending evaluation questionnaires at any time by using the link in the questionnaire email.

If you agree to the transfer of personal data for the purpose of evaluating the purchase, we will forward the information about the order together with your e-mail address to Seznam.cz. Seznam.cz may then use them to obtain an independent evaluation of our products and services. The transferred personal data will be kept only for the time necessary for this use.

We process personal data obtained through cookies on the basis of your consent (which you grant by the appropriate settings of your internet browser). We use personal data obtained through cookies mainly for the purpose of providing user support, improving our services, including analysis of user behavior and marketing.

We may only use your personal data for a purpose other than that for which it was obtained with your consent.

How long do we utilize the data?

We utilize the personal data entered within the inquiring and ordering of goods or services or within the registration only for the time necessary for the fulfillment of the Contract and the fulfillment of legal obligations, or to protect our legal claims.

If you give us your explicit consent to the processing of personal data or if we use your e-mail address to send commercial messages and/or review and improve our services and our goods in accordance with the previous article, the data will be used for the duration of the Web interface on which we will offer services or goods similar to those provided to you.

 

YOUR RIGHTS IN RELATION TO PERSONAL DATA

Revocation of the Consent to the Personal Data Processing.

If we process your personal data only with your consent (i.e. without any other legal reason), you can revoke this consent at any time.

Withdrawal of consent to the processing of your personal data is possible at any time, namely:

via e-mail sent to our contact e-mail address;

by telephone at our contact telephone number;

in writing by letter sent to our delivery address;

in the case of commercial communications – in the manner indicated in each e-mail containing the commercial communication (by clicking on the unsubscribe link or otherwise).

Withdrawal of consent does not affect the lawfulness of data processing carried out until the withdrawal of consent to processing.

Right of Access to Personal Data

You have the right to ask us for information on whether we process your personal data. If we process your data, you have the right to access this personal data and in particular to the following information:

purpose of processing;

categories of personal data processed;

the recipients or categories of recipients to whom the personal data will be made available;

the envisaged period for which the personal data will be stored;

Upon your request, we will provide you with a copy of the processed data. For additional copies, we may charge you an administrative fee not exceeding the cost of making and delivering such additional copies.

Right to Rectification

If your personal data is inaccurate or incomplete, you have the right to request immediate correction, i.e. correction of inaccurate data and/or addition of incomplete data.

Right to Object to Processing

You have the right at any time to object to the processing of your personal data if we process it for direct marketing purposes, including any automated processing of personal data. After the objection, we will stop processing your personal data for these purposes.

Right to Erasure (‘Right to Be Forgotten’)

You have the right to request that we delete your personal information if:

personal data are not necessary for the purposes for which they were processed;

you have revoked your consent to processing;

you have objected to the processing of personal data;

personal data were processed illegally.

Unless there are legal grounds for refusing to delete, we are required to comply with your request.

Right to Restriction of Processing

You have the right to request that we restrict the processing of your personal data if:

you deny the accuracy of your personal information;

the processing is illegal and you are requesting a restriction on the processing of personal data instead of deleting it;

If the processing of personal data is restricted due to an objection to the processing, the restriction lasts for the time necessary to determine whether we are obliged to comply with your objection.

If the processing of personal data is restricted due to a denial of data accuracy, the restriction lasts for the period of data accuracy verification.

Right to Data Portability

You have the right to obtain your personal data that you have provided to us in a structured, commonly used and machine-readable format and to pass it on to another personal data controller.

You can exercise your personal data rights through our contact details. All information and actions will be provided to you without undue delay.

When protecting your personal data, we will do our best to accommodate you. However, if you are not satisfied with the settlement, you have the right to contact the relevant authorities, in particular the Office for Personal Data Protection (http://www.uoou.cz/en), which supervises the protection of personal data. This provision does not affect your right to contact the Office for Personal Data Protection directly with your complaint.

In particular, if your residence, place of employment or the place of the alleged breach of personal data protection is located outside the Czech Republic in another member state of the European Union, you can contact the relevant supervisory authority in that member state.

We are a controller of personal data within the meaning of the Regulation.

To the extent necessary to fulfill the Contract or other obligations, we are entitled to pass on your personal data to other persons, such as carriers or other persons involved in the performance of the Contract or our obligations. Alternatively, we may entrust other processors and recipients of personal data. We will also let you know who specifically processes your personal data based on your inquiry.

Your personal data will not be transferred to countries outside the European Union, unless this is necessary for the performance of the Contract or for any other reason in accordance with the rules for such transfer laid down in the Regulation.
